摘 要:住宅小区是居民日常生活的重要空间。小区物业服务与人民群众的切身利益息息相关,在改善小区业主生活质量、维护小区公共秩序等方面发挥着重要作用。由于我国物业服务行业起步较晚,相应的配套制度不够完善,导致物业服务合同纠纷不断增多,直接影响了业主生活质量和物业公司正常运转。物业服务合同纠纷实质性化解难度较大,成为基层社会治理的突出难题。基于人民法院审理物业服务合同纠纷案件的现状,探讨强化物业服务合同纠纷诉源治理,从根本上修复业主与物业服务公司之间的关系,可以有效减少涉物业服务合同矛盾纠纷,促进社会稳定和谐。Residential communities are important spaces in the daily lives of residents.Community property services are closely related to the vital interests of the people and play an important role in improving the quality of community owners’life and maintaining public order in the community.Due to the late start of China’s property service industry and inadequate supporting systems,disputes over property service contracts continue to increase,directly affecting the quality of property owners’life and the normal operation of property companies.The substantive resolution of disputes over property service contracts is difficult and has become a prominent challenge in grassroots social governance.Based on the current situation of handling disputes over property service contract in people’s courts,this paper explores strengthening the governance of litigation sources for disputes over property service contract and fundamentally repairing the relationship between owners and property service companies,to effectively reduce conflicts and disputes related to property service contracts to promote social stability and harmony.
