轻罪立法背景下我国犯罪记录封存制度构建

摘　　要：轻罪立法符合我国当下法治体系建设的趋势,完成劳教制度废除遗留下的历史任务的同时,在积极的刑法立法观的指导下,通过设立轻罪解决部分罪名“口袋化”的司法困境,适应我国犯罪结构的变化,以促进我国刑法朝着“严而不厉”的方向发展。轻型犯罪的迅速扩张带来了不利后果,在轻罪立法的背景下,前科报告制度给犯罪人打上标签,不利于其重回社会、再就业,轻罪犯罪人的权利得不到应有的保障。轻罪记录封存制度符合平等的价值需求和保障机能的要求,是提升我国社会治理法治化水平的有力保障。具体构建上,可学习未成年人犯罪记录封存制度的经验,明确轻罪记录封存的对象、程序以及监督救济机制。The legislation of misdemeanor is in line with the current trend in the construction of our legal system.While accomplishing the historical task left by the abolition of the re-education through labor system and under the guidance of positive criminal law legislation,we can solve the judicial dilemma of the“pocketing”of some charges through the establishment of misdemeanors,which is adaptive to the changes of crime structure and can promote the development of China’s criminal law in the direction of“strict but not severe”.The rapid expansion of misdemeanor crime has brought unfavorable consequences.Under the background of misdemeanor legislation,the criminal record reporting system labels the criminals in a way that is not conducive to their reintegration into society and re-employment,and the rights of the criminals cannot be guaranteed properly.The criminal record sealing system is in line with the value of equality and the requirements of the function of safeguarding,which is a powerful guarantee for the enhancement of the legalization of China’s social governance.In terms of the specific construction,we can learn from the experience of juvenile criminal record sealing system and clarify the objects,procedures and the mechanism of supervision and relief.
