法律文学翻译国家性探要——从沙博理英译《水浒传》谈起

摘　　要：国家翻译对象特殊,翻译受制于国、服务于国。法律文学服务“群治”,基本属性和价值功能趋于复合,相关翻译由国家策动,应有机构在场。本文从作为国家翻译对象的法律文学本体切入,基于翻译主体适格论审视法律文学翻译国家实践的译者群体及协同机制,以沙博理译《水浒传》为例从译者适格性和译事制度化两方面阐释法律文学翻译的国家性。法律文学翻译扎根史实,面向现实,可为建构原生法律形象,讲好传统法律故事提供进路。The objects of state translation,with multi-dimensional textual features and discourse functions,tend to be translated by the state and for the state.The translation of legal literature,for instance,should be conducted and supervised by certain institutions as state engineering.This paper,focusing on legal literature as the objects,intends to clarify the translator group and collaborative mechanism of state translation of legal literature based on the theory of the properness of translators,and then takes Shapiro's English translation of Shuihu Zhuan as a case to elucidate the stateness of the translation in terms of the properness of translators and institutionalization of the translation event.The translation of legal literature is anchored in historical materials and oriented towards the present,conducive to constructing original images and telling traditional stories concerning rule of law.
