摘  要:汉初的“汉儒批法”及随后的“儒法合流”并不仅仅是一个文化事件,其背后反映着封建大一统权力秩序对于中国传统文化发展乃至整个社会价值建构的客观要求,本质上是封建统治秩序的价值重构。但作为统治策略的“儒法合流”,并没有真正解决“家天下”所带来的一系列社会问题,尤其是德治和法治的有效结合问题,反而造成了“礼高于法”等一系列封建社会秩序建构的缺陷,并影响到了随后整个中华传统文化的发展。中华优秀传统文化的现代转型,必须基于中国式现代化的历史逻辑,探索其与社会主义核心价值观的内在一致。The“The Criticism of Legalist School from Han Confucianism”in the early Han Dynasty and the subsequent“the Convergence of Confucian and Legalist School”is not only a cultural event,but also a reflec-tion of the objective requirements of the feudal order of power for the development of traditional Chinese cul-ture and even for the value construction of the whole society,which is essentially a value reconstruction of the feudal order.However,the“the Convergence of Confucian and Legalist School”as a ruling strategy did not really solve a series of social problems brought about by the“Family World”,especially the effective combina-tion of the rule of morality and the rule of law,but instead created a series of feudal social problems such as“Rites Superior to Law”and so on.Instead,it resulted in a series of defects in the construction of feudal social order,and affected the subsequent development of the entire traditional Chinese culture.The modern transfor-mation of Chinese excellent traditional culture must be based on the historical logic of Chinese-style moderni-sation and explore its internal consistency with socialist core values.
