摘　　要：黑格尔将国家视为普遍意志与个体自由意志相结合的有机体,该有机体具有“自下而上”和“自上而下”的双向运动逻辑。一直以来,学界主要从“自下而上”的一维视角分析黑格尔国家有机体发展的逻辑进路,这种线性阐释极易误解国家有机体的运动本质,其一方面将国家降低为由个体意志或社团意志抽象决定的产物,另一方面将国家仅视为促进个体自由实现的规范性保障。要克服这种线性认识的关键在于,须把《法哲学原理》的方法论基础建立在理念自我展开的运动逻辑之上。通过概念辩证法,黑格尔国家有机体将被阐释为:“自下而上”和“自上而下”双向运动的同一过程。这一过程由“个人”“社会”“国家”作为逻辑精神内在环节的推理系统提供原始动力,而该推理系统自身又可区分出若干子系统,由各子系统的推理联动展示出国家有机体完整而具体的生命活力。determination of individual or com-munal will,and on the other hand,it only regards the state as a normative guarantee for the realization of the freedom of the individual only.The key to overcoming this linear understanding is to base the methodology of The Philosophy of Right on the movement logic of the self-unfolding of the idea.Through conceptual dialec-tics,Hegel’s state organism will be interpreted as the same process of“bottom-up”and“top-down”two-way movement.This process is primordially fueled by a system of reasoning in which“individual”,“society”and“state”are intrinsic links in the spirit of logic.The reasoning system itself can be distinguished into several subsystems,and the reasoning linkage of each subsystem shows the complete and specific life vitality of the state organism.
