摘　　要：刑事诉讼司法解释方法论是在刑事诉讼司法解释制定过程中,为确保司法解释的规范性与稳定性而构建的一种系统的方法理论,它关系到刑事诉讼法能否得到遵守。刑事诉讼司法解释方法论的构建要素可以为司法解释的制定和实施提供指导和规范。这些要素中,司法解释理念决定司法解释的基本方向和思维方式;司法解释目标是司法解释活动的目的和追求的结果;司法解释原则是在司法解释理念的指导下具体操作的准则;司法解释程序是实现司法解释目标的具体操作过程;法律论证是司法解释程序中确保司法解释严密性和科学性的重要环节。这五大构建要素提高了司法解释的质量和水平,增强了刑事诉讼法的可预测性和可操作性。Judicial interpretation methodology in criminal procedure refers to a systematic methodological theory established during the process of formulating judicial interpretations in criminal procedure to ensure the normalization and stability of judicial interpretation.It is crucially related to whether or not the Criminal Procedure Law can be effectively adhered to.The construction elements of judicial interpretation methodology in criminal procedure can provide guidance and norms for the formulation and implementation of judicial interpretation.Included in these elements are:the ideals of judicial interpretation,which determines the basic direction and mode of thinking of judicial interpretation;the objectives of judicial interpretation,representing the purpose and desired outcomes of such interpretative activities;the principles of judicial interpretation,serving as specific operating guidelines under the guidance of the judicial interpretation concept;the procedures of judicial interpretation,embodying the concrete steps taken to achieve those predefined objectives;legal argumentation,an essential component within the procedural structure to ensure the rigor and scientific validity of judicial interpretations.Such five construction elements help to enhance the quality and level of judicial interpretations,thereby increasing the predictability and practical operability of the Criminal Procedure Law.
