摘　　要：新时代背景下,刑法学价值存在从侧重自由保障到自由与安全二元价值并重的转型需要,应当以总体国家安全观重塑刑法的价值需求,推进自由与安全二元价值在刑法中的融合。犯罪学实践范式具有消极性、滞后性,难以承担引领刑法学研究的理论重担,应当以总体国家安全观重构刑法的实践范式,重视具有积极性、前瞻性的国家安全学实践范式对刑法学发展的指引作用。以总体国家安全观为引领,一要调整刑事政策,坚持刑事政策发展的系统性导向;二要强化安全的刑法保障,以人民安全为理论根基促进刑事立法的民主化和科学化发展;三要激发刑事司法机能化,推进刑事司法在个人、社会、国家三重安全面向的机能性构建。In the context of the new era,there is a need to transform the value of the criminal law from focusing on the guarantee of freedom to the dualistic value of freedom and security.The overall national security concept should be used to reshape the val⁃ue requirements of the criminal law and promote the integration of the dualistic value of freedom and security in the criminal law.The practical paradigm of criminology has the features of negativity and hysteresis,and can hardly bear the theoretical mis⁃sion of leading the criminal law research.It is necessary to reconstruct the practical paradigm of the criminal law on the basis of the overall national security concept,and attach importance to the guiding role of the positive and forward⁃looking practical para⁃digm of national security science in the development of the criminal law.With the overall national security concept as the guide,first,we should improve the criminal policy,adhere to the systemic orientation of criminal policy development;second,we should strengthen the security guarantee for the criminal law,promote the democratization and scientificity of criminal legislation with the people’s security as the theoretical foundation;third,we should activate the functionalization of the criminal justice,promote the functional construction of criminal justice in the aspects of personal,social and national security.
