摘　　要：方法论定位与方法性构造是刑法类型化的首要问题。对应着法律类型化属于法学方法论中的法律方法论,刑法类型化属于刑法学方法论中的刑法方法论。但在刑法方法论中,刑法类型化并非完全取代刑法概念式思维,而只是居于刑法方法的主导性地位。刑法类型化方法的优势地位既可从刑法概念化的方法劣势中对比出来,也可从其自身得到直接展示。刑法类型化所对应的方法论可分解为刑法立法方法论和刑法司法(解释)方法论,但刑法类型化的方法性在从刑法立法到刑法司法的刑法实践过程中保持着连贯性与一致性,从而体现着刑法类型化作为刑法方法的基本性和全面性。只有从“方法论”地位到其“构造性”,刑法类型化才能作为一种刑法方法而被予以完整、深刻的理解和把握。Methodology orientation and methodological construction are primary issue of criminal law typification.Just like legal typification is part of legal methodology within methodologies of law,criminal law typification is part of methodologies of criminal law.However,criminal law typification is just in a predominant position of criminal methodologies instead of replacing criminal concept thinking.The dominant position of criminal law typification can be shown by both comparing to criminal concept thinking and by itself directly.The methodology corresponded by criminal law typification can be divided into criminal legislative methodology and criminal judicial(explanatory)methodology,but the methodological nature of criminal law typification holds its consistency and uniformity in criminal practice from criminal legislation to judicature.Therefore,it shows fundamentality and comprehensiveness of criminal law typification which is seen as criminal methodology.Only by transferring perspective from orientation of“methodology”to its“constructivity”,criminal law typification can be understood and grasped completely and profoundly.
