设立国际组织内部司法上诉机制的理论探析

摘　　要：内部司法作为国际组织有效维护其独立性的机制,对组织履行职能产生重要影响。建立上诉机制,使国际组织内部司法得到创新性发展,有利于组织更加充分、高效地履行职能。国际组织内部司法上诉机制使得有关判决有机会得到重新审查和纠错,有利于维护国际组织职员和行政当局的上诉权,更好地平衡其权利义务关系,推动组织内部法治建设。设立国际组织内部司法上诉机制的纠错功能价值主要体现在权益保障功能和协调功能两个方面;设立国际组织内部司法上诉机制的法治精神价值则体现在国际组织内部对法治精神的期待,国际组织内部司法上诉机制本身所体现的法治精神。As a mechanism for international organizations to maintain their independence effectively,their internal justice gives an important impact to the performance of the organization’s function.The establishment of an appellate mechanism symbolizes the innovative development of the international organizations internal justice and facilitates the fulfil their functions more efficiently.The internal judicial appellate mechanism of international organizations supplies the opportunity to review and correct the relevant judgments,which benefits to safeguard the appeal rights both of international civil servants and administrative authorities of the organizations,balance their rights and obligations better,and promote the rule of law within them.So it’s possible to draw on the successful experiences of the concerned organizations to build a relatively complete internal judicial mechanism with two trials,including the first trial and the appeal trial,so as to resolve their internal staff disputes better,to promote their functional performance efficiently,and to realize the national interests of China through these international organizations.
