摘 要:随着时代的发展,舞蹈作品的法律保护客体和范围也应结合舞蹈自身的发展规律以及科学技术的发展而向前拓展。作者在创作舞蹈作品时,在舞蹈动作、姿势等基础元素之上,又增加了如背景、服装、道具、妆容、情节等额外元素,并把该等额外元素的选择和编排作为其舞蹈作品的一部分,该部分内容体现了作者独创性的选择和编排,体现了作者的独创性表达,将该部分内容纳入舞蹈作品的客体保护范围有利于对舞蹈作品作者智力成果的完整保护。在发生舞蹈作品的侵权行为时,我们需要多维度分析侵权行为表现,在立法滞后的情况下可以适当运用法律解释的方法以及反向排除的规则来解决关于舞蹈作品法律保护的相关疑难问题。With the development of the times,the object and scope of legal protection of dancing works should also be expanded in combination with the development of dance itself and the development of science and technology.When creating dance works,the author adds additional elements such as background,costume,props,makeup,plot and so on to the basic elements such as dance movements and postures,and takes the selection and arrangement of these additional elements as a part of his dance works,which reflects the author's original choice and arrangement as well as his original expression.Including this part of the contents in the scope of object protection of dancing works is conducive to the complete protection of the intellectual achievements of the authors of dancing works.When the infringement of dancing works occurs,we need to analyze the performance of infringement in a multi-dimensional manner,and in the case of lagging legislation,we can appropriately use the method of legal interpretation and the rule of reverse exclusion to solve the relevant difficult problems concerning the legal protection of dancing works.
