摘　　要：湘西土家族苗族自治州黄金茶古茶树资源具有丰富的经济价值、文化价值、生态价值与社会价值。开展古茶树资源法律保护研究,对完善地方立法、推动保护条例制定具有重要意义。当前黄金茶古茶树资源保护存在现实与法律上的困境,文章在概括古茶树概念、黄金茶特色优势与法律规定的基础上,从扩展保护路径、完善条例内容、完善处罚规定3个方面提出建议,以期为黄金茶古茶树资源法律保护的完善提供有益参考。The ancient tea plant resources of Golden tea in Xiangxi Tujia and Miao Autonomous prefecture have rich economic,cultural,ecological,and social value.The research on the legal protection of ancient tea plant resources is of great significance for improving local legislation and promoting the formulation of protection regulations.There are practical and legal difficulties in protecting the ancient tea plant resources of Golden tea.Based on summarizing the concept of ancient tea plant,the unique advantages of Golden tea and legal provisions,this paper put forward suggestions from three aspects:Expanding the protection path,improving the content of regulations and perfecting punishment provisions,in order to provide useful reference for the improvement of legal protection of ancient tea plant resources of Golden tea.
