论我国立法者职业伦理教育的三重维度

摘　　要：立法者是政治共同体向善的推动者,是一个国家法治体系建设的主导者。为了促进立法“真、善、美”的实现,立法者必然遵循基本的职业伦理,这是法治建设题中应有之义。立法者职业伦理教育至少需要涵盖三重维度的内容:基本的德性,主要体现为立法者内在良善和外在为民品性双向均衡的教育和规训;恰当的知识,主要体现为立法者应当遵循的法律规范和必须坚守的政治规矩两者之间整诠性知识的教育和规训;融贯的技术,主要体现为立法者对立法自身技术(立法内在技术)和辅助立法技术(立法外在技术)互动反身性知识的教育和规训。这三重维度的教育和规训是作为“忠、优、好”立法者的基本要件与关键保证。我国应加强对立法者三重维度的宏观培育和微观引导,以促进良法的制定和善治的落实,从而为推进国家治理体系和治理能力现代化提供重要的动力保障和人才支撑。Legislators are the promoters of goodness in the political community and the leaders of the construction of a country's rule of law system.As important members of the legal profession,legislators must follow basic professional ethics in order to promote the realization of the truth,goodness and beauty of legislation,which is the proper meaning of the rule of law.Its professional ethics education needs to cover at least three dimensions:basic virtue,which mainly embodies in the two-way balanced education and discipline of legislators'internal goodness and external civil character;appropriate knowledge,which from a macro perspective,mainly includes the education and discipline of comprehensive knowledge between the legal norms that legislators should follow and the political rules that must be adhered to;coherent technology,which means the education and discipline of the interactive reflexive knowledge of the legislator's own legislative technology(legislative internal technology)and auxiliary legislative technology(legislative external technology).The education and discipline of these three dimensions are the basic elements and key guarantees for“loyal,excellent and good”legislators.China should strengthen the macro cultivation and micro guidance of the three dimensions of legislators,so as to promote the formulation of scientific laws and the implementation of good governance,and provide important power guarantee and talent support for the modernization of the national governance system and governance capacity.
