摘  要:“双一流”建设背景下,一流法治人才培养离不开一流的课程建设。经过多年的探索,依托法学学科,在我国法律硕士研究生的课程建设的实践过程中,课程内容相对稳定,较好地覆盖了法学专业所需的必要知识,突出了分类培养和职业化的理念;注重实践能力的培养,“双师”计划逐步实施,案例教学法成为法律硕士教学的主导方法;考核方式较为灵活,评价标准体现了学术性与实践性的统一。但也存在课程目标与社会需求脱节;课程设置两极分化,结构失衡;课程实施过程弱“学术性”与“实践性”;课程考核方式随意,考核结果没有发挥分流淘汰作用的问题。造成这些问题的原因是多方面的,既有目标层面的,也有课程内容设置层面的;既有课程之间关系和体系建设方面的,也有建设标准和机制方面的原因。因此,需要对标“双一流”建设,培养卓越法律人才;分类建设、分类培养,构建分类课程模块;加强课程之间的逻辑性与关联性,构建科学的课程体系;完善课程建设机制,加强课程过程管理,构建法律硕士研究生课程体系等有效措施予以改进。In the background of the project of building the“Double First-Class”Universities in China,the cultivation of first-class rule of law talent cannot be separated from the construction of first-class curriculum.After years of exploration,in the practice of curriculum construction for postgraduates of Master of Law in China,the following advantages have been formed in the discipline of law:(1)the content of the curriculum is relatively stable,better covering the necessary knowledge required by the legal profession,highlighting the concept of classification and vocational training;(2)the legal education focuses on the cultivation of practical ability,the dual teacher program is implemented step by step,and the case method has been implemented;(3)the assessment methods are more flexible,and the evaluation standards reflect the unity of the academic and practical attributes.However,there are also some problems in legal education,such as:(1)the disconnection between course objectives and social needs;(2)the polarization and imbalance of the curriculum;(3)the lack of attention to the integration of the“academic”attribute and the“practical”attribute in the teaching process;(4)the arbitrary way of course assessment,and the results of the assessment do not play a role in the evaluation;(5)the course assessment method is arbitrary,and the assessment results do not play the role of triage and elimination.The reasons for these problems are multifaceted,including the level of objectives,the level of course content,the relationship between courses and system construction,as well as the construction standards and mechanisms.Therefore,the author suggests that legal education needs to cultivate excellent legal talent according to the standard of the“Double First-Class”construction.In addition,legal education should be carried out in a categorized way and the curriculum modules should also be built with classifications.In addition,in legal education the logic and correlation between courses should also be strengthened
