质证权语境下证人证言可信性审查研究

摘　　要：通过证人证言认定案件事实,需要经过证据准入和评估两个阶段,主要围绕证人证言的可信性审查展开。司法实践中,证人证言可信性的质证存在证人不出庭、质证能力低、质证运行差、质证后不评价和忽略非语言行为等问题,导致证人证言可信性审查不足,庭审质证虚化,案件事实认定不准确。应从“证言三角形理论”分析证人证言的形成机制,明确证人证言可信性的内核,进而确立证人证言审查重点,即证人证言的法律可信性、逻辑可信性和补足可信性,并设置“三步走”可信性审查模式,以弥补现有证言可信性审查的不足,提升案件事实认定的准确率,推进“以审判为中心”的司法体制改革。To determine the facts of a case through the testimony of a witness needs to go through two stages of evidence access and evaluation,which mainly focuses on the review of the credibility of the witness testimony.In judicial practice,there are some problems in the crossexamination of witness testimony credibility,such as witness failure to appear in court,low crossexamination ability,poor cross-examination operation,non-evaluation after cross-examination and neglect of non-verbal behaviors,which lead to insufficient examination of witness testimony credibility,false cross-examination of trial,and inaccurate identification of case facts.We should analyze the formation mechanism of witness testimony,clarify the kernel of the credibility of witness testimony,and then establish the key points of witness testimony examination,namely the legal credibility,logical credibility and complementary credibility of witness testimony,and set up a"three-step"credibility examination mode to make up for the shortcomings of the existing credibility examination of witness testimony and improve the accuracy of case fact determination.We will promote the reform of the judicial system with"trial as the center".
