国际刑事法院被害人信托基金的赔偿功能研究

摘　　要：《国际刑事法院罗马规约》创立的被害人信托基金的重要功能是执行法院的赔偿命令,落实对被害人的赔偿。信托基金实行独立的董事会管理体制,并与国际刑事法院开展有效合作。信托基金在现阶段面临的主要挑战是,稀缺的赔偿资源不能涵盖诉讼外所有受到犯罪侵害的被害人、有限的赔偿能力无法达到人们过高的期待、缺少赔偿监督机制难以确保赔偿金的实际交付。为了使信托基金更好地发挥赔偿功能,应由信托基金而非法院掌握对基金“其他资源”的自主使用权,审慎制定赔偿命令,优先保障诉讼内被害人获得赔偿,善用象征性赔偿方式,与国家和国际组织形成合力,抚平犯罪给被害人和国际社会造成的创伤,促使国际刑事司法制度从纯惩罚性正义向恢复性正义的模式转变。The Rome Statute of the International Criminal Court created the Trust Fund for Victim,and one of its important functions is to implement the reparations orders of the Court.The Trust Fund has an independent Board of Directors and conducts effective cooperation with the International Criminal Court.Nowadays,the challenges faced by the Trust Fund include that the scarce reparation resources cannot cover any harm which can be assessed to be a consequence of the crimes for which the accused has been convicted,the limited reparation capacity cannot meet people’s high expectations,and the lack of reparation supervision mechanism to ensure the disbursemen of awards.To make the Trust Fund better play its reparation function,it is the Trust Fund rather than the Court who has the autonomy over“other resources”of the fund,approach the grant of reparations cautiously so that at a minimum the identified victims in the proceedings can be compensated,make good use of symbolic reparation methods and form a joint force with nations and other international organizations,to heal the trauma caused by crime to the victims and the community,prompt the transformation of the international criminal justice system from purely punitive justice model to restorative justice model.
