从惩治型反腐败到预防型反腐败立法转向的逻辑延展

摘　　要：“腐败”是指掌握一定公共权力的公职人员,不合目的地行使权力谋取私益的行为。对我国现有立法进行评估可知,当前我国仍然以“结果无价值论”为导向的事后惩治型立法为主。在面临腐败新形势的当下,为满足党的二十大“一体推进三不腐”的政策要求,我国应借鉴国外成功经验,在“行为无价值论”指导下向预防型反腐败立法转变。具体而言,应当建立预防腐败的有机体系,首先,建立预防型反腐败基本法:《反腐败法》;其次,合理应用预防型保障法:纪检监察法;再次,完善预防型反腐败的配套制度:党内法规与行政法规;最后还要对预防型反腐败的配套刑事惩戒作出完善。"Corruption"refers to the behavior of public officials who hold certain public power and unintentionally use that power for personal gain.According to the evaluation of the existing legislation in our country,we can see that our country is still based on the post-punishment legislation oriented by the theory of result without value.In the face of the new situation of corruption,in order to meet the policy requirements of promoting“three non-corruptions in one body”,our country should learn from the successful experience of foreign countries,and change to preventive anti-corruption legislation under the guidance of behavioral value-free theory.To be specific,first of all,we should establish an organic system to prevent corruption,and establish a preventive anti-corruption basic law Anti-Corruption Law;secondly,reasonable application of preventive protection law,that is,discipline inspection and supervision law;thirdly,improve the supporting system of preventive anti-corruption,that is,intra-party regulations and administrative regulations;finally,it is necessary to improve the preventive anti-corruption supporting criminal punishment.
