《精神卫生法》视域下心理治疗相关法律困境及其对策研究

摘　　要：分析现行《精神卫生法》对心理治疗实施主体资格及从业资格的相关规定,其对处理心理治疗中的问题上有一定的规制作用,但太过原则、抽象和模糊,使心理治疗的法律适用存在一定问题;从对心理治疗实施主体及接受治疗者的权益保障出发,分析我国心理治疗活动的现实法律困境,探讨立法需求、立法可能性,并提出完善《精神卫生法》中的相关规定及相关的司法解释、制定“心理师法”以明确心理治疗的从业资格标准的相应对策与建议,以填补现行法律中空白,使心理治疗的实施更加规范化和法治化。and vague,which leads to some problems in the application of the law of psychotherapy.Starting from the protection of the rights and interests of the subjects of psychotherapy and those receiving psychotherapy,this paper analyzes the realistic legal dilemma of psychotherapy activities in China,discusses the need for legislation and the possibility of legislation,and puts forward corresponding countermeasures and suggestions to improve the relevant provisions in the Mental Health Law and the relevant judicial interpretation,and formulate the"Psychologist Law"to clarify the qualification standards of psychotherapy in order to fill the gaps in the current law,and better standardize and legalize the implementation of psychotherapy.
