纠纷调解中的藏语法谚类型研究

摘　　要：在藏族传统的纠纷调解过程中会运用诸多藏语谚语。依据语的使用方法、功能和内容,可将纠纷调解中所用的谚语分为三类:第一是一般的民间语,其本身并不具备法的属性,然而传统的纠纷调解是通过使用谚语来实现其语言的传达效能的,因此,语成为纠纷调解过程中不可或缺的语言工具,也是达成调解、产生律法效应的重要媒介。第二是表现纠纷调解人员的身份地位、能力和作用,以及反映法的重要性与案件调解的公平程度,纠纷调解时所用的此类谚语也是藏民族了解调解人员和对法的认知与理解的一面镜子。第三是表现法的原则与本质的语,这类谚语将法的精神、内容直接且精炼地进行总结,在纠纷调解过程中,突出其调解的作用与法的地位,甚至归纳、制定出一种原理,以明示纠纷调解过程中可能出现的各类问题的解决方法。总之,文章通过分析纠纷调解与法谚之间的关系,以及在纠纷调解中语表现其法的属性的特征进行了深入的解析,探究了在传统的纠纷调解过程中藏族谚语具备的多种类型。Dispute mediation in Xizang has certain judicial attributes,and many proverbs are used in the traditional dispute mediation process in Xizang.According to the method of using proverbs,their function and content,proverbs used in dispute mediation can be divided into three categories:the first one is general folk proverbs,which do not have the attribute of law in itself,but traditional dispute mediation realizes its language conveying effect through the use of proverbs,so proverbs become an indispensable linguistic tool in the process of dispute mediation,and also an important medium to reach mediation and produce the effect of the law.Secondly,proverbs that express the status,ability,and role of the mediator,as well as the importance of the law and the fairness of mediation in a case.Such proverbs used in dispute mediation also serve as a mirror for Xizang to learn about the mediator and their knowledge and understanding of the law.Thirdly,there are proverbs that express the essence of the law.These proverbs summarize the spirit and content of the law directly and concisely,highlight the role of mediation and the status of the law in the process of dispute mediation,and even summarize and formulate a principle to show the solution to all kinds of problems that may arise in the process of dispute mediation.In conclusion,by analyzing the relationship between dispute mediation and legal proverbs,as well as analyzing in-depth the characteristics of proverbs in dispute mediation that express the attributes of law,this thesis explores several types of proverbs in the traditional dispute mediation process in the Tibetan language.
