居住权对老年婚姻法律机制构建的推动作用

摘　　要：随着我国进入老龄社会,老年婚姻逐渐成为不容忽视的现象,对金钱、精神及生活质量等方面的需求也是老年婚姻区别于传统两性婚姻的主要原因。我国应高度重视老年婚姻法律机制的构建,消除老年人及其子女的顾虑。通过分析婚姻模式的转变、老年人婚姻的产生原因及现实阻碍,探究居住权对老年人婚姻的推动作用,并提出相关的建议,构建适合我国老年型社会的老年婚姻法律机制。With our country entering the aging society,elderly marriage has gradually become a phenomenon that cannot be ignored,the demand for money,spirit,quality of life and so on is also the main reason why elderly marriage differs from the traditional gender marriage.China should attach great importance to the construction of legal mechanism for marriage among elderly,so as to eliminate the concerns of the elderly and their children.By analyzing the changes of marriage patterns,the causes and practical obstacles of marriage among the elderly,this paper explores the role of residence right in promoting the marriage of the elderly,and puts forward relevant suggestions to construct a legal mechanism for the marriage of the elderly suitable for the elderly society in China.
