摘　　要：随着《行政诉讼法》的修订,行政协议被正式纳入到行政诉讼的范畴,最高人民法院也通过司法解释全面规定了行政协议案件的审理规则。但因行政协议实体立法缺位,实践中行政协议损失赔偿的法律适用仍然存在许多分歧与困惑。本文立足司法审判实践需要,对涉及损失赔偿的法律规范进行梳理分析,提出行政协议损失赔偿的法律适用顺序原则,在优先适用《行政诉讼法》规定的基础上,分类处理行政协议损失赔偿的法律适用问题。在缔结阶段行政机关违法造成的损失赔偿,适用《国家赔偿法》的规定;而履行阶段则参照适用民事法律规范。此外,参照适用民事法律规范需要考虑衡平原则、完全赔偿原则,也需要对自治原则进行限缩,以此为基础提出对现行的行政协议损失赔偿进一步完善的具体构想。With the revision of the Administrative Procedure Law,administrative agreements have been officially included in the scope of administrative litigation,and the Supreme People's Court has also compre-hensively stipulated the trial of administrative agreement cases through judicial interpretations.However,due to the absence of substantive legislation on administrative agreements,there are still many differences and confusions in the law application of loss compensation under administrative agreements in practice.Based on the needs of judicial trial practice,this article sorts out and analyzes the legal norms involving loss compen-sation,puts forward the principle of the order of application of laws for loss compensation under administra-tive agreements,and deal with the issues about the law application of loss compensation under administra-tive agreements according to classifications on the basis of giving priority to the provisions of the Administra-tive Procedure Law.In the conclusion stage,the provisions of the State Compensation Law shall apply to compensation for losses caused by administrative agencies'violations of laws;but in the performance stage,civil legal norms shall apply with reference.In addition,the principles of equity and full compensation need to be considered when applying with reference to civil legal norms,and the principle of autonomy also needs to be restricted.Based on this,specific conceptions for further improving the current system of loss compen-sation under administrative agreements are proposed.
