论虚假商事仲裁的检察监督

摘　　要：在经济生活中,商事仲裁是极为重要的替代性纠纷解决机制。进入新时代以来,在加强检察机关法律监督工作的要求下,检察机关强化对虚假商事仲裁的民事法律监督逐渐提上日程。当前,在商事仲裁制度和机构具有局限性、人民法院司法审查缺乏主动性、案外人和当事人欠缺合理的权利救济渠道等情形下,检察机关成为实施虚假商事仲裁法律监督的合适主体,但是也面临案件线索少、调查核实难、限于执行阶段等困境。检察机关应通过强化线索收集和移送机制、充分运用调查核实权、适度扩大虚假仲裁监督范围、加强多部门协作配合、灵活制发检察建议等积极措施,不断提升虚假商事仲裁检察监督质效。Under the requirement of strengthening the legal supervision of procuratorial organs in the new era,the procuratorial organs have gradually put on the agenda to strengthen the civil legal supervision of false commercial arbitration.Considering the limitations of the arbitration system and the arbitration institutions,the lack of initiative of the people’s court in judicial review,and the lack of reasonable right relief channels for outsiders and parties involved,the procuratorial organ becomes a suitable subject for the implementation of legal supervision of false arbitration due to its obvious advantages in functional positioning,active review,investigation and collection of evidence.However,at present,procuratorial supervision is faced with difficulties such as few clues,difficult investigation and verification,and the fact that procuratorial supervision only operates at the implementation stage.In this regard,we suggest that procuratorial organs strengthen the mechanism of collecting and transferring clues,fully utilize the power of investigation and verification,moderately expand the scope of fake arbitration supervision,strengthen internal and external cross-department cooperation,comprehensively and flexibly produce and issue procuratorial suggestions,and improve the quality and effectiveness of procuratorial supervision of fake commercial arbitration.
