摘 要:证据是刑事诉讼的核心,证据转化是环境行政执法中环境刑事案件移送和承接的基础。由于我国环境行政违法行为和环境犯罪行为适用“二元立法”模式,以及受相关法律法规的制约和“环境两法”证据特殊属性的影响,环境行政执法与刑事司法衔接中证据转化面临证据转化规则模糊、证据转化范围不明、证据审查标准不统一等问题。鉴于此,应当在遵循“二元立法”模式及相关法律法规基础上,结合环境行政证据与刑事证据的不同属性,探究“两法”证据转化的具体规则,厘清环境犯罪证据转化的范围,统一环境犯罪证据审查认定标准。Evidence is the core of criminal procedure,and evidence transformation is the basis of transferring and undertaking environmental criminal cases in environmental administrative law enforcement.Due to the“dual legislation”mode applied to environmental administrative violations and environmental crimes in our country,the restriction of relevant laws and regulations and the influence of the special attribute of evidence in the“two environmental laws”,the evidence transformation in the convergence of environmental administrative law enforcement and criminal justice is faced with such problems as fuzzy evidence transformation rules,unclear scope of evidence transformation,and inconsistent evidence examination standards.In view of this,we should,on the basis of following the“dual legislation”model and relevant laws and regulations,combine the different attributes of environmental administrative evidence and criminal evidence,explore and clarify the rules of evidence transformation of“two laws”,clarify the scope of evidence transformation of environmental crimes,and unify the examination and identification standards of environmental crime evidence.
