摘 要:1989年《行政诉讼法》规定了变更判决,2014年修订时适度扩大了变更判决的适用范围,但变更判决在实践中的运用仍然极少。变更判决面临的困境有:一是“明显不当”的概念不清,二是适用范围存在争议,三是裁量权收缩的适用条件过于严苛,四是法院对变更判决适用尺度不一。针对以上困境,提出如下建议:首先,“明显不当”限于社会公众能明显感受到的不适当;其次,在行政处罚中仅限于结果明显不当;再次,适用条件未必限于裁量权收缩至零,在仅对处罚结果有争议或者是行政机关不作为乱作为的情形下可以适用变更判决;最后,建立裁量基准使法院可以参考判断是否“明显不当”。The Administrative Litigation Law of 1989 provided for the modified of judgment,and in 2014 amendment,the scope of application of the change of judgment was moderately expanded.However,the application of the change of judgment in practice is still very limited.The difficulties faced by modified judgments include the unclear concept of“obvious inappropriate”,the controversial scope of application,the excessively strict conditions for the contraction of discretion,and the varying standards of court application for modified judgments.In response to the above dilemma,the following recommendations are made:first of all,“obvious inappropriate”is limited to the inappropriateness that the public can clearly feel;secondly,in administrative penalties,it is only limited to the obvious inappropriate of the results;thirdly,the application conditions may not necessarily be limited to the contraction of discretionary power to zero,and in cases where there is only controversy over the punishment results or administrative inaction,modified judgments can be applied;finally,a discretionary benchmark can be established so that the court can refer to and judge whether it is“obvious inappropriate”.
