摘  要:高校学生纪律处分是指依据法律、法规、规章和校规校纪,对破坏学校教育教学秩序或纪律的学生,按照正当的程序,所给予适当的、具有惩罚性的行政处罚措施,是维护教育教学秩序与培育高质量人才的重要手段。当前,我国高校学生纪律处分存在着重手段轻目的、执行过程“裁量失范”等现象,究其根本在于忽视了高校纪律处分中法理兼情理的双重性。在对学生实施纪律处分时,应基于学生的情感诉求,限制管理者的主观偏见,在遵循平等、合理正当、客观公正等原则的基础上,坚持预防为主、宽严相济,以促进成长为目的,引导失范学生打破旧我生成新我、从他律走向自律。Disciplinary actions for college students refer to appropriate and punitive administrative penalties given to students who disrupt the order or discipline of school education and teaching in accordance with laws,regulations,rules,and school rules and regulations on the basis of legitimate procedures.It is an important means of maintaining education and teaching order and cultivating high-quality talents.At present,there are phenomena in disciplinary actions against college students in China,such as emphasizing methods over objectives,and“improper discretion”in the execution process.The fundamental reason for this is the neglect of the dual nature of jurisprudence and emotion in disciplinary actions against college students.Therefore,when implementing disciplinary actions against students,it is necessary to limit the subjective biases of managers based on students’emotional demands.On the basis of principles such as equality,reasonable and just,and objective fairness,we should take prevention as the main focus,and combine leniency with severity in order to promote their growth.This should guide abnormal students to eliminate the old self and generate a new one,which helps them move from heteronomy to self-discipline.
