摘  要:随着技术的进步和市场的成熟,智能汽车在市场上得到广泛普及,汽车数据共享也逐渐成为行业发展的重要趋势。通过数据共享,智能汽车之间实现互联互通,极大程度地提升城市交通效率,为智慧城市的建设注入新动力的同时,汽车企业通过搜集和共享智能汽车数据,与科研机构开展科研合作,共同推动相关技术创新和产业升级,进而形成产学研用深度融合的良性发展格局。然而,结合现有法律体系来看,智能汽车数据共享在数据权属、数据流通、数据安全等各个方面,尚未形成完善的规制框架,这也导致数据共享在实践过程中面临诸多法律障碍。对此,本文阐述智能汽车数据共享法律规制的必要性,分析智能汽车数据共享所面临的困境,探究其法律规制路径,以期能够促进智能汽车数据共享的健康有序发展。With the progress of technology and the maturity of the market,intelligent cars have been widely popularized in the market,and automotive data sharing has gradually become an important trend in the development of the industry.Through data sharing,the interconnection between intelligent vehicles is realized,which greatly improves the efficiency of urban transportation and injects new momentum into the construction of smart cities.At the same time,automobile enterprises collect and share intelligent vehicle data,carry out scientific research cooperation with scientific research institutions,and jointly promote related technological innovation and industrial upgrading,which in turn forms a benign development pattern of the in-depth fusion of industry,academia,research and application.However,in light of the existing legal system,smart car data sharing has not yet formed a perfect regulatory framework in terms of data ownership,data circulation,data security and other aspects,which has led to many legal obstacles in the practice of data sharing.In this regard,this paper describes the necessity of legal regulation of smart car data sharing,analyzes the dilemmas faced by smart car data sharing,and explores the path of its legal regulation,in order to promote the healthy and orderly development of smart car data sharing.
