摘　　要：民间借贷案很多采用公告送达,实务中公告送达一般借助报刊告知被告应诉的相关问题,是一种有偿服务,刊登所产生的费用需要原告先行付费。可问题是,有的公告费主张不一定能得到支持;有的却依职权径直判决公告费由败诉方负担。总之,公告费负担问题各持己见,难以形成有效的意见,以致实务中判决不能统一。为此,通过对18份借贷案件裁判文书进行深入剖析,从法理上充分阐述公告费性质,从而得出公告费应由败诉方负担的结论,以助于审判机关作出科学裁决,提高审判质量。Many cases of private lending are served by public announcement.In practice,announcement service generally informs the defendant of relevant problems with newspapers and periodicals,which is paid by the plaintiff in advance.The problem is that some of the announcement fee claim may not be supported and sometimes the announcement fee is determined to be paid by the losing party.In short,it is difficult to form effective opinions on who should pay the fee,so that the judgment can not be unified in practice.Therefore,based on an in-depth analysis of the 18 judgment documents of loan cases,the article fully elaborates the nature of the announcement fee from the legal perspective,so as to draw the conclusion that the fee should be borne by the losing party to help the judicial organs to make a scientific ruling and improve the quality of the trial.
