论中国法理学史学科的创立

摘　　要：法理学是法学学科体系中的二级学科与基础学科。在法理学这个二级学科的框架下,还有一个更具基础地位的法学分支学科,那就是中国法理学史。为了阐明中国法理学史学科的价值与意义,应当首先理解中国法理学史在法学学科体系中的位置。在此基础上,有必要把西方法理学史作为中国法理学史研究的一个参照。与此同时,还应当在中国法理学史研究与中国法律思想史研究之间形成良性互动的关系。立足学术传承与学术创新并重,有必要充分尊重梁启超等人所开创的中国法理学史研究范式,同时借鉴外来的研究经验,创立相对独立的中国法理学史学科,以推进中国法理学史的研究,进而为建构中国自主法学知识体系、法学学科体系奠定更加坚实而深厚的理论根基。Jurisprudence is a secondary and fundamental discipline within the legal discipline system.Within the framework of the second level discipline of jurisprudence,there is a more fundamental branch discipline,which is the history of Chinese jurisprudence.In order to clarify the value and significance of the study of the history of Chinese jurisprudence,it is necessary to first understand the position of the history of Chinese jurisprudence in the legal discipline system.On this basis,it is necessary to use the history of Western jurisprudence as a reference for the study of the history of Chinese jurisprudence.At the same time,a positive interactive relationship should also be formed between the study of the history of Chinese jurisprudence and the study of the history of Chinese legal thought.Based on the equal emphasis on academic inheritance and academic innovation,it is necessary to fully respect the research paradigm of the history of Chinese jurisprudence created by Liang Qichao and others,and at the same time,draw on foreign research experience to establish a relatively independent discipline of the history of Chinese jurisprudence,promoting the research of the history of Chinese jurisprudence,thus laying a more solid and profound theoretical foundation for China's independent legal knowledge system and legal discipline system.
