教育信任与教育法治——一种文化制度主义的解释路径

摘  要:有学者用“信任危机”“信任赤字”等描述当代教育治理中的“失序”状态。所谓“失序”是站在国家公权力的角度上显示出教育公共治理的难度,但从另一个角度则体现出现代社会人们教育自决、教育自主,甚至教育自治的新时代权利要求。从文化制度主义的角度来看,教育信任问题的关键是受教育者不相信自己合理的受教育权利能够在制度性框架内公平且稳定地实现。因此,我国的教育法治实践的前提和基础是重建社会主义市场经济背景下的教育信任关系,从构建有利于促进信任关系的教育制度结构入手,在中观层面强化教师职业道德体系,规范职业监管、社会监管和教师个人信用评价制度。Some scholars use"trust crisis"and"trust deficit"to describe the"disorder"state of contemporary education governance.However,the so-called"disorder"is standing on the point of view on national public power to show the difficulty of the educational public governance.From another perspective,it reflects the self-determina-tion,independent education,or even a new era's educational autonomy rights requirements on people in the modern society.From the perspective of cultural institutionalism,the key to the problem of trust in education is that the edu-cated do not believe that their reasonable right to education can be fairly and stably realized within the institutional framework.Therefore,the premise and basis of our country's educational law practices is the reconstruction of the educational trust under the background of socialist market economy.It should be reconstructed by building educa-tional institutional structure that promots the trust relationship,enhancing the teachers'professional ethics system in the medium level,regulating professional supervision,social supervision and teachers'personal credit evaluation sys-tem.
