论《监察法学》的框架结构与编撰要点

摘　　要：《监察法学》被列入中国法学类马工程重点教材申报范围,标志着监察法学教材建设进入新阶段。监察法学既是纪检监察学科的重要组成部分,又是法学学科的重要分支。《监察法学》应以坚持和完善党的自我革命规范体系、国家反腐败法治体系为逻辑起点,以监察法律法规为研究主干,以监察法治实践及其规律性研究为范畴,以政治学、宪法学、法理学、诉讼法学等社会科学理论为学理支撑,按照基本原理、组织制度、程序制度、履职规范、实施保障的立法逻辑进行架构设计和各板块、各章节内容编撰,从监察法理、监察源流、监察制度、监察实践四个维度构建中国监察法学自主知识体系。Supervision Law has been corered under the application of the“Maxism Projectkey Textbooks”for Chinese Law Majns,which marks a new stage in the construction of supervision law teaching materials.Supervision Jurisprudence is not only an important part of discipline inspection and supervision,but also an important branch of law.We should adhere to and improve the Party's self-revolutionary normative system and the country's anti-corruption legal system as the logical starting point,take supervisory laws and regulations as the main research backbone,and take the practice of supervising the rule of law and its regularity as the scope.It is supported by the theories of social sciences such as political science,constitutional law,jurisprudence and procedural law.According to the basic principles,organization system,procedure system,performance norms and legislative logic of implementation guarantee,the structure design and the content of each section and each chapter are compiled,and the independent knowledge system of China's supervisory law is constructed from the four dimensions of supervision jurisprudence,supervision source,supervision system and supervision practice.
