“控制下交付”侦查措施运用中存在的问题及对策分析--以郑州铁警“7·27专案”为例  

Problems and Countermeasures Analysis in the Application of Investigation Measures of“Controlled Delivery”--Taking the“July 27th Special Case”of Zhengzhou Railway Police as an Example

摘　　要：以郑州铁警“7•27专案”为例,探讨了“控制下交付”侦查措施在实践运用中存在的案件深挖、毒品控制方式、安全保证和非实态性控制下交付等问题,认为其原因在于属地办案的局限、毒品犯罪案件侦查工作的指导思想不明确、对危险的认识程度不足和安全意识较弱,以及办案人员专业知识缺乏等。完善建议:(一)建立以运毒马仔为中心和向上、向下两条主干线路的“一中心、二主干”控制下交付指导模式;(二)建立个案分析、类案辅助判断的方法;(三)注重综合性侦查措施的使用;(四)安全优先,确保侦查人员和毒品的安全;(五)加强专业队伍建设;(六)注重打击贩毒网络,树立整体办案思想。Taking Zhengzhou Railway Police’s“July 27th Special Case”as an example,this paper explores issues such as deep excavation of the case,drug control methods,safety assurance and non-real state of controlled delivery and so on in the practical application of investigation measures of“controlled delivery”.It is believed that the reasons for this are the limitations of territorial handling of cases,the lack of clear guiding ideology for the investigation of drug-related crimes,the insufficient awareness of the dangers and the weak sense of security,and the lack of specialized knowledge on the part of case handlers.The improvement recommendations are:(1)establishing hatchet man who transports drugs as the center and the guiding model of controlled delivery with“one center and two branches”of two upward and downward main lines;(2)establishing the methods of case analysis and determining the case with the assistance of similar cases;(3)paying attention to the use of comprehensive investigative measures;(4)ensuring the safety of the investigators and drugs with the priority of security;(5)strengthening the building of professional team;(6)focusing on combating drug-trafficking networks and establishing a holistic approach to the handling of cases.
