摘　　要：刑事诉讼法条解构式案例研习法是在借鉴德国的鉴定式案例分析方法的基础上形成的案例教学方法。以余金平交通肇事案为例,该教学方法可以分为选择问题、界定问题、涵摄问题和回答问题四个逻辑思维步骤,即选定案例涉及的核心问题,以现行立法规定为依据对问题进行解析,将立法规定与案例事实进行比较考量,从而得出问题的最终答案。在运用该教学方法时,应注重教师作用的发挥和案例研习报告的写作,应鼓励学生进行延伸性思考,并与其他实践教学方法进行有机结合。The deconstructive case study method of legal provisions in criminal procedure is a case teaching method based on the German appraisal case analysis method.Taking Yu Jinping traffic accident case as an example,the teaching method can be divided into four logical thinking steps:including problem selection,problem definition,problem subsuming and problem response,namely to select the core problems involved in cases,analyse these problems based on the current legislative provisions,compare the legislative provisions with the facts of the case,and thus conclude the final answer of the problem.In the application of this teaching method,we should pay attention to the role of teachers and the writing of case study report,students should be encouraged to extend their thinking,and this method should be organically combined with other practical teaching methods.
