摘 要:为强化教材建设国家事权地位,国家从机构设置、制度建设和政策激励上进行了一系列顶层设计。在国家事权视域下,法学教材建设不仅面临着教材管理、教材规划、教材审核、编写方式、出版准入和备案等教材建设机制中国化的挑战,而且受法学学科体系和现代信息技术的冲击,亦面临着教材内容时代化和教材形式多样化的挑战。构建中国自主法学教材体系是实施法学教材建设的必然路径,具体而言:应坚持正确导向,以习近平法治思想统领法学教材建设,并注重提炼和总结中国法治经验,注重对中国优秀传统法律文化的创造性转化和发展;要处理好立足中国与借鉴国外、政治性与学术性、统编教材与自编教材这三对关系;建设好法学核心课程教材、法学新兴学科和交叉学科教材、涉外法学/国际法学教材、法学实践实训类教材这四个系列。A series of top⁃level designs have been carried out in China in terms of institutional setting,system construction and policy incentives in order to strengthen the national authority status of teaching materials construction.From the perspective of national authority,the construction of law teaching materials not only face the challenges of localization of construction mechanisms,such as management,planning,review,compilation,publishing access and filing of teaching materials,but also face the challenges of modernization of content and diversification of form due to the impact of law discipline system and modern information technology.The inevitable path to implement the law teaching materials construction is to build its independent system in China.Specifically,it should adhere to the correct guidance of Xi Jinping Thought on the Rule of Law,and focus on refining and summarizing China’s experience in the rule of law,and on the creative transformation and development of Chinese excellent traditional legal culture.It should properly handle the three pairs of relations between being based on China and learning from foreign countries,political nature and academic nature,state⁃compiled teaching materials and self⁃compiled teaching materials.It should construct the four series of teaching materials that is law core curriculum,law emerging disciplines and cross⁃disciplines,foreign⁃related law or international law,and legal practice and training.
