摘 要:职业教育学生实习学习权是职业教育学生在接受专业实习训练过程中学习、理解、掌握和运用相关职业岗位知识与技能的权利,其构成包括该项权利的权利主体、权利内容、权利客体三项要素。保护好职业教育学生实习学习权是职业教育作为类型教育发展和高质量发展的必然要求,也是技能型社会建设的需要。但在职业教育实习中,存在着因学生实习学习权的权利主体的学生身份被异化、权利内容实现不充分、权利客体运作不周全等造成的学生实习学习权被侵害。我国需要从权利构成的角度,多措并举,加大对学生实习学习权的保护。The internship learning rights of vocational education students is the right to learn,understand,master and apply relevant knowledge and skills of vocational posts in the process of receiving professional internship training.Its constituent elements include the subject of rights,the content of rights and the object of rights.It is an inevitable requirement for vocational education taking as a typological education with high-quality development to protect the internship learning rights of vocational education students,and it is also the need for the construction of a skilled society.However,there are infringements of students’internship learning rights caused by the alienation of students’identity of the subject of rights,the inadequate implementation of rights content,and the incomplete operation of rights object in the practice of vocational education.Therefore,China needs to take multiple measures to increase the protection of students’internship learning rights from the perspective of the composition of rights.
