多法统筹视角下我国体育仲裁管辖权界的协调论

摘　　要：新修订的《中华人民共和国体育法》对我国体育仲裁作出许多创新规定,深度推进我国体育纠纷治理,管辖权是其核心议题。因多头划界,体育仲裁管辖范围与周边解纷机制存在交叉。研究认为,应在《中华人民共和国仲裁法》《中华人民共和国劳动争议调解仲裁法》《中华人民共和国民事诉讼法》等多法统筹视角下,解析我国体育仲裁管辖权界协调问题,并实现体育仲裁与周边解纷机制在管辖权上的“三重协调”:1)事际协调旨在厘定商事仲裁、劳动仲裁与体育仲裁的管辖权界,核心是根据争议事项的法律性质和关系结构,明确三者的各别管辖和合并管辖范围;2)空间协调旨在厘定体育组织内部、国内与国际3种体育争端解决机制间的管辖权界,核心是确立专属管辖、先后位序与意思自治原则,准确实现管辖分流;3)程序协调旨在厘定调解、仲裁与诉讼3类体育解纷程序间的管辖权界,核心是明确可调解性、可仲裁性和可诉性三者之间的包含与监督关系。据此划定我国体育仲裁管辖权界,并在多法统筹视角下提出其与周边解纷机制的协调方案。Law of the People’s Republic of China on Sports(2022 Revision)has introduced many innovative provisions for sports arbitration,significantly advancing the governance of sports disputes,with jurisdiction being a core issue.Due to overlapping jurisdictions,there are intersections between the jurisdiction of sports arbitration and surrounding dispute resolution mechanisms.From the perspective of multiple laws,such as the“Arbitration Law of the People’s Republic of China,”“Law of the People’s Republic of China on Labor-dispute Mediation and Arbitration,”and“Civil Procedure Law of the People’s Republic of China,”this study analyzes the coordination of jurisdiction boundaries in sports arbitration in the country and achieves a“triple coordination”of jurisdiction between sports arbitration and surrounding dispute resolution mechanisms:1)Inter-jurisdictional coordination aims to determine the jurisdiction boundaries of commercial arbitration,labor arbitration,and sports arbitration.It involves considering the legal nature and relational structure of the disputed matters to clarify the separate jurisdiction and concurrent jurisdiction of these three mechanisms.2)Spatial coordination aims to determine the jurisdiction boundaries between three types of sports dispute resolution mechanisms:internal sports organizations,domestic,and international.The core objective is to establish exclusive jurisdiction,sequential order,and the principle of autonomy,to achieve accurate jurisdictional allocation and ensure proper division among these mechanisms.3)Procedural coordination aims to determine the jurisdiction boundaries between mediation,arbitration,and litigation in sports dispute resolution procedures.The core objective is to clarify the inclusion and supervision relationships between the three:ediability,arbitrability,and justiciability.Based on this,the jurisdiction boundaries of sports arbitration in China can be effectively delineated,and a coordination plan with surrounding dispute resolution mechanis
