摘 要:目前专门针对居住权的登记制度仍处于法律空缺状态,实践中虽有地方性登记规范予以弥补,但由于《民法典》对居住权登记要素规定较为简单,导致实践中各地做法差异化。为统一居住权登记制度,应从居住权基础理论入手,厘清居住权登记争议,明确裁判可以设立居住权,将遗嘱型居住权细分为遗嘱继承居住权和遗赠居住权,登记效力上分别采用登记宣示主义和登记生效主义,并类型化规定居住权登记申请主体,由此完善居住权登记规范。At present,the registration system specifically for the right of residence is still in a state of legal vacancy.Although there are local registration regulations to make up for it in practice,the Civil Code has simple provisions on the elements of registration of the right of residence,leading to different practices in practice.In order to unify the residence registration system,we should start with the basic theory of residence,clarify the dispute of residence registration,clarify that the judgment can establish the right of residence,subdivide the testamentary residence into the right of testamentary inheritance and the right of legacy residence,adopt the doctrine of registration declaration and registration validity respectively in the registration effect,and type the subject of application for residence registration,so as to improve the registration standard of residence registration.
