摘 要:专断医疗行为因侵犯患者的身体健康法益和知情同意权,具备了刑事可罚性的基础。将这种行为纳入刑事治理的范围,充分体现了国家对患者生命健康和自主决定权的重视。基于专断医疗行为的具体情况和现行的规制路径,笔者提出应采用民事和刑事相结合的治理模式,其中部分行为应纳入刑事处罚。具体入罪的标准应结合医学适应性、诊疗规范性以及造成的损害结果等因素综合判定。同时,建议将专断医疗行为视为医疗事故罪中“严重不负责任”的行为类型,并依据患者的损伤结果考虑适用刑事和解制度。Arbitrary medical behavior has a criminal punishable basis for infringing on the legal interests of patients' physical health and informed consent.Including it in the scope of criminal governance fully reflects the importance placed on the patient's life and health as well as their right to make independent decisions.Based on the specific patterns and current regulatory paths of arbitrary medical behavior,the author proposes a partial criminalization model that combines civil and criminal governance.The determination of whether to criminalize should be based on factors such as medical adaptability,diagnostic and treatment norms,and the resulting damage.Moreover,arbitrary medical behavior should be improved as a type of“serious irresponsibility”behavior in medical accident crimes,And propose suggestions for applying the criminal reconciliation system based on the patient's injury results.
