轻罪治理双重机制实证研究——以S市P区的检察实践为样本

摘　　要：构建轻罪治理体系,是新时代推进市域社会治理现代化、提升国家犯罪治理效能的必由之路。因应我国刑事案件轻罪化、轻刑化的结构性变化,检察机关结合办案实践探索建立轻罪治理“快处”和“慢处”的双重处理机制,为检察权积极融入社会治理、创造更高水平的社会主义司法文明探索新的路径。未来,通过扩大附条件不起诉的适用范围、加强“快处”机制的跨部门工作协同、探索企业合规撤回起诉机制、建立轻罪前科消灭制度等措施,进一步优化轻罪治理体系,提升轻罪治理实效。Building a misdemeanor governance system is the way to promote the modernization of municipal social governance and enhance the effectiveness of national crime governance in the new era.In response to the structural changes in the misdemeanorization and decriminalization of criminal cases in China,the procuratorial authorities have explored the establishment of a dual processing mechanism of“quick”and“slow”misdemeanor management in conjunction with the practice of handling cases,exploring new paths for the active integration of procuratorial power into social governance and the creation of a higher level of socialist judicial civilization.In the future,by expanding the scope of application of conditional non-prosecution,strengthening the cross-departmental coordination of the“fast-track”mechanism,exploring the mechanism of withdrawal of prosecution by enterprises in compliance with the law,and establishing a system of elimination of previous misdemeanor convictions,the misdemeanor governance system will be further optimized and the effectiveness of misdemeanor governance will be enhanced.
