摘　　要：人工智能技术正深刻改变着生产结构和生产关系,以生产实践为基础的社会结构和人类本性亦面临有史以来最大挑战和最深刻瓦解。人工智能技术的异化逐渐导致人类社会的异化,人类社会全面进入技术人类生活形态。由此带来诸多伦理和法理挑战,可能危及人类生存,甚至终结人类。根据马克思主义技术哲学理论,人工智能技术的发展陷入“粗俗唯物主义”窠臼,人与世间万物都被抽象化、可计算化,技术理性超越人类理性,技术开始支配人类,人工智能技术异化趋势愈加明显。这需要法哲学为相关立法提供正确指引,用法律规制和引导人工智能技术的资本主义生产方式和运用方式,用法的价值约束引导人性欲望,从而推动人类社会向新技术人类生活共同体迈进。Artificial intelligence technology is profoundly changing the production structure and production relations,the social structure and human nature based on production practice are also facing the biggest challenge and the most profound collapse in history.The alienation of artificial intelligence technology gradually leads to the alienation of human society,and human society has entered the technological human life form.As a result,it brings many ethical and legal challenges,and may even endanger the survival of human beings and even end human beings themselves.According to Marxist philosophy of technology theory,the development of artificial intelligence technology falls into the pattern of"vulgar materialism".People and all things in the world are abstracted and calculable.Technological rationality surpasses human rationality,and technology begins to dominate human beings.The alienation trend of artificial intelligence technology is being more obvious.This requires legal philosophy to provide correct guidance for the legislation,to regulate and guide the capitalist production mode and application mode of artificial intelligence technology by law,to restrict and guide the human desire by using the value of law.So as to promote the human society to the common form of new technology human life We are moving forward.
