摘 要:便民原则并非仅是一种价值倡导,除指导立法以外,便民原则能够在司法适用层面体现其独有的规范内容,即行政机关应当积极履行法定职责,禁止不完全作为与不合理迟延;在不影响履行职责的前提下,积极实现相对人的合理请求,适当减免当事人的程序负担。在行政法基本原则体系中,便民原则是在“控权”基础上的“赋权”,对其它行政法原则具有重要的补充功能。便民原则的适用需要考量多重限度,包括法定职权的适度扩张与法定管辖权、个体意愿的适当实现与公共利益、行政行为瑕疵治愈的限制以及作为非正式裁判方式的建议适度运用。In addition to guiding legislation,the principle of convenience can reflect its unique normative content at the level of legal application.administrative organs should actively perform their statutory duties and prohibit incomplete actions and unreasonable delays;on the premise of not affecting the performance of their duties,they should actively realize the reasonable requests of the relatives and appropriately relieve the procedural burden of the parties.In the system of basic principles of administrative law,the principle of facilitation is"empowerment"on the basis of"control"and has an important complementary function to other principles of administrative law.The application of the principle of expediency requires consideration of multiple limits,including the appropriate expansion of statutory powers and jurisdiction,the appropriate realization of individual wishes and the public interest,the limits on the cure of defects in administrative acts and the appropriate use of advice as an informal adjudication method.
