摘 要:检察机关长期以来对批准逮捕的决定不公开说理,其主要原因在于逮捕措施的功能定位异化、审查逮捕程序过于封闭,加之公开说理存在一定的风险,以致检察机关不愿意说理、难以说理、不敢说理和不屑于说理。构建批准逮捕决定的公开说理机制,既是贯彻习近平法治思想、保障和促进社会公平正义的内在要求,也是淡化逮捕的追诉色彩、促使逮捕回归作为诉讼保障措施的功能定位的需要;还是从制度上持续稳定地减少羁押性强制措施适用以及打破审查逮捕程序的封闭性、实现审查逮捕程序正当化的需要。在现有实践经验的基础上,构建批准逮捕决定公开说理机制的条件已经具备。为了确保改革的有序推进,需认真研究解决说理职责、说理模式、律师帮助和救济途径四个重点问题。The procuratorate have long been reluctant to give reasons publicly for their decisions to approve pre-trial detention,mainly due to the alienation of the functional position of detention measures,the overly closed deten-tion review procedures,and the presence of certain risk in public reasoning,which led to the procuratorate being unwilling to reason,difficult to reason,hesitant to reason,and disdainful to reason.It is necessary to establish a public reasoning mechanism in order to enforce Xi Jinping's Thought on the Rule of Law and promote social justice,further downplay the prosecution color of pre-trial detention and return to the functional position of pre-trial detention as a procedural preventive measure,continuously and steadily reduce the application of custodial coercive measures,break the closure of the pre-trial detention review procedure,and legitimize the process.Based on existing practical experience,the conditions for establishing a public reasoning mechanism for approving pre-trial detention decisions have been met.In order to ensure the reform progress orderly,it is necessary to carefully study and solve four key issues:reasoning duties,reasoning models,lawyer assistance,and relief channels.
