摘　　要：基于控审分离原则,检察机关的精准化量刑建议属于求刑权,而非具有终局性质的量刑权。认罪认罚从宽制度改革影响的是法院对量刑权的行使方式,法院量刑方法从相对封闭的单独量刑向多主体参与的合作量刑转变,并侧重对量刑建议是否明显不当进行审查。检察机关作出量刑建议时,应兼顾实体公正和程序公正,并根据量刑事实查证程度、案件复杂程度、量刑经验积累程度合理选用确定刑或幅度刑量刑建议。法院应对认罪认罚案件的量刑建议进行全面实质审查,量刑建议是否明显不当,应当根据刑罚是否与犯罪事实、性质、情节和对社会危害程度相当进行判断。法检两机关应注重分工配合和监督制约,稳妥处理与精准化量刑建议相关的上抗诉案件,确保认罪认罚从宽制度改革行稳致远。Based on the principle of separation of prosecution and adjudication,the procuratorate's precise sentencing recommendations should belong to the right to seek punishment,rather than the final sentencing power.The reform of the leniency system for confession of guilt and punishment affects the way the courts exercise their sentencing power.The court's sentencing has changed from a relatively closed individual sentencing to a cooperative sentencing involving multiple subjects,and focuses on reviewing whether the sentencing proposal is obviously inappropriate.When procuratorial organs make sentencing recommendations,they should give consideration to both substantive justice and procedural justice,and reasonably choose definite or range-based sentencing recommendations according to the degree of sentencing facts,the complexity of the case,and the experience accumulation of sentencing.The court should conduct a comprehensive and substantive review of the sentencing recommendations in plea cases.Whether the sentencing recommendations are obviously inappropriate should be judged on whether the punishment is commensurate with the facts,nature,circumstances,and degree of harm to society of the crime.The procuratorate and the court should pay attention to the division of labor,cooperation and supervision,and properly handle appeal cases related to precise sentencing recommendations,so as to ensure that the reform of the plea leniency system is smooth.
