刑事热点案件司法回应的优化途径

摘　　要：热点案件司法回应有利于构建司法与社会公众沟通与互动的有效途径,是司法机关应对热点案件频频引发社会舆情的有益实践,有利于推动实现司法公正,但在操作层面仍有待进一步优化。刑事热点案件司法回应是独立于常规刑事诉讼程序的辅助性措施。虽然目前司法机关已就刑事热点案件司法回应形成“热点识别-辅助办案-信息发布-跟进发布”的四阶段基本样态,但仍存在热点识别能力不足,信息发布的时效性、准确性及权威性有待提升,对跟进发布的重视不足的问题。应建立热点案件司法回应协调机制,提升热点识别能力,坚持信息发布时效性、准确性与权威性的统一,重视网络谣言的识别及应对,注重发挥新闻发布会及主流媒体的作用等。The judicial response to hot cases builds up an effective way of communication and interaction between the judiciary and the public.It is a beneficial practice of the judiciary to cope with the public opinion frequently triggered by hot cases,which is conducive to the realization of judicial justice,but still needs to be further optimized at the operational level.The study of criminal hotspot case judicial response has fuller practical significance.Judicial response to criminal hotspot cases is an auxiliary measure independent of the regular criminal procedure.At present,the judicial organs have formed a four-stage basic pattern of"hotspot identification-assisted case handling-information release-follow-up release"for judicial response to criminal hotspot cases.However,there are still problems of insufficient ability to identify hot spots,the timeliness,accuracy,and authority of information release need to be improved,and insufficient attention is paid to follow-up releases.Accordingly,six optimization proposals were put forward to establish a coordinating mechanism for judicial response to hotspot cases in advance,including improving the ability to identify hotspots,insisting on the unity of timeliness,accuracy,and authority of information release,attach importance to follow-up release,attach importance to the identification and response to Internet rumors,and attach importance to the role of press conferences and mainstream media.
