摘  要:随着人工智能技术的进步,自动驾驶汽车开始在世界范围内得到研发支持和推广应用。相较传统的人工驾驶汽车,自动驾驶汽车的优势是能利用智能驾驶系统实时感知路面信息,整体驾驶安全性较高。但自动驾驶技术作为一项新兴技术,与之相匹配的法律法规与管理制度并不完善。当自动驾驶汽车发生交通事故时,责任主体确认和过错认定存在巨大的争议。为此,文章探讨了自动驾驶汽车侵权责任的特殊性,从侵权责任认定标准、侵权事实认定和赔偿责任落实等角度分析了自动驾驶汽车侵权责任划分的法律困境,并针对性提出了若干侵权责任认定建议。With the progress of artificial intelligence,autonomous vehicles have been promoted and applied worldwide.Compared with traditional vehicles,autonomous vehicles utilizes the intelligent driving system to perceive road conditions in real time,thus their overall safety is higher.However,as an emerging technology,the matching laws,regulations,and management systems are not yet perfect,which brought about huge controversy over the confirmation of the parties of responsibility and the fault determination of traffic accidents involving autonomous vehicles.For this reason,the article discusses the particularity of the tort liability of autonomous vehicle,elaborates on the dilemma of the division of the tort liability from the perspectives of the determination standard,the determination of tort facts and the compensation liability,and puts forward some targeted suggestions.
