审判阶段企业环境刑事合规的司法认定

摘　　要：基于环境资源犯罪的特征,较多的环境刑事合规案件进入审判阶段。在现有司法实践中,不论是检察机关还是审判机关主导的环境刑事合规的司法认定,都以涉案企业有效修复生态法益为前提,并呈现出启动的宽泛性特点、认可的积极性与量刑的宽容性。从功能上说,审判阶段企业环境刑事合规的司法认定能够体现程序正义、契合控审分离与探索协商性司法。构建符合中国特色的审判阶段企业环境刑事合规司法认定路径,在启动时应当由检察机关主导、审判机关进行形式审查;在具体程序中,审判机关对企业环境刑事合规实施实质审查;裁量时将日常合规作为量刑的酌定从轻情节,将有效的环境刑事整改合规作为量刑的法定从轻情节。Based on the characteristics of environmental resource crimes,a large number of environmental criminal com-pliance cases have entered the trial stage.In existing judicial practice,both the procuratorial organs and the adjudicatory or-gans take effective restoration of ecological legal interests by the involved enterprises as a prerequisite for judicial deter mina-tion of environmental criminal compliance,demonstrating broad initiation,recognized positivity,and leniency in sentencing.Functionally speaking,judicial determination of corporate environmental criminal compliance at the trial stage can reflect pro-cedural justice,conform to the separation of control and adjudication,and explore negotiated justice.To construct a path for judicial determination of corporate env ironmental criminal compliance at the trial stage that is in line with Chinese character-istics,it should be led by procuratorial organs during initiation and undergo formal examination by adjudicatory organs;dur-ing specific procedures,adjudicatory organs conduct substantive examination on corporate environmental criminal compliance;when exercising discretion in sentencing,daily compliance should be considered as a mitigating factor while ef-fective rectification measures for environmental crimes should be considered as statutory mit igating factors.
