论认罪案件法庭审理中的自由证明

摘　　要：自由证明承载着缓和严格证明之僵硬性、平衡个人权利与国家利益的多元价值。此证明方法因与认罪案件具有的协商性司法特征、以量刑问题为核心的法庭审理内容,以及证据裁判原则于认罪案件法庭审理中的应然松动等特性相契合而得以在此场域内适用。但受制于我国粗线条勾勒式的立法模式,自由证明于司法实践与法律规范之间呈现出实然与应然层面的落差,为优化该证明方式于法庭审理中的有效适用,除对认罪案件法庭审理中自由证明之调查方法、调查程序及主观化证明的适用样态加以明晰外,尚需形成以完善审判独立原则的内外部配套条件、确立中国式的审前证据开示制度以及加强认罪案件审判程序下刑事法官的庭前阅卷职责为具体内容的本土优化路径。The free proof carries multiple values to ease the rigidity of strict proof and balance individual rights and national interests.This proofing method can be applied to the court trial of guilty plea cases because it is consistent with the deliberative judicial characteristics of guilty plea cases,the court trial content with sentencing as the core,and the principle of evidential judgment should be loose in the court trial of guilty plea cases.But under the control of the legislative model of broad-brush outline type in our country,there are gaps both at the present and reality levels between the free proof in the judicial practice and legal norms.To optimize the way prove the effective application of court trial,in addition to the proof of guilt in the trial court free survey method and survey procedure and the applicable shape of subjective proof to be clear,it is still necessary to form a local optimization path to perfect the internal and external supporting conditions of the principle of trial independence,and establish the Chinese-style pre-trial evidence discovery system and strengthen the criminal judge's pre-trial examination duty under the trial procedure of guilty plea cases.
