湖北省医疗损害赔偿纠纷的演进特点及风险防范--基于中国裁判文书网2006-2022年案例样本的分析

摘　　要：分析中国裁判文书网上2006-2022年的226件湖北省医疗损害赔偿纠纷判例样本,发现其具有纠纷解决周期相对较长、相对集中于经济较发达地区、三级综合性医院涉案最频繁、外科和妇产科占比偏多、采用司法鉴定的占比高、诊疗操作不规范和手术不当在损害原因中占比大、鉴定结论中的过错程度极大影响法院判决的特点,并针对这些判例的特点提出风险防范对策。By analyzing 226 cases of medical damage compensation disputes in Hubei Province from 2006 to 2022 on China Judg⁃ment Documents Website,it is found that it has the characteristics of relatively long dispute resolution cycle,relative concentration in economically developed areas,most frequent involvement of tertiary general hospitals,a larger proportion of surgery and obstetrics and gynecology,a higher proportion of judicial expertise application,a larger proportion of non-standard diagnosis and treatment operations and improper operations as damage causes,and the great impact of the degree of fault in the appraisal conclusion on the court judgment.Thus risk prevention measures are put forward according to the above-mentioned characteristics.
