摘　　要：探讨立案受理制度下“被告明确”要件的性质与处理模式,分析是否应在起诉阶段以“当事人适格”标准判断,以及应采取何种程序回应。结合司法案例,从诉讼要件与诉的利益理论层面分析,促进诉权保障,分散诉讼压力。This paper explores the nature and handling mode of the"defendant clarity"requirement under the case acceptance system,analyzes whether it should be judged by the"party qualification"standard at the stage of prosecution,and what procedures should be taken in response.Combining judicial cases,it analyzes from the perspective of litigation requirements and the theory of litigant interests to promote the protection of litigation rights and alleviate litigation pressure.
