摘 要:国际工程具有复杂程度高、合同额度大、工程建设周期长、利益相关者众多等特点,其中国际工程最鲜明的特点就是境外施工,由于工程项目受到工程所在国(地区)的法律约束,同时国际工程也往往面临着汇率、政治、物价上涨等风险。对于DB模式下的项目,如何在项目实施过程中规避这些风险,最好的方式就是运用合同去管理各参与方。介绍了DB模式下的合同特征、风险识别、合同风险产生因素等,并具体阐述了如何进行合同风险管理的措施,探讨了国际工程合同管理的健康发展之路,以助于提高施工企业在国际工程中对合同风险的应对能力。International projects are featured with high complexity,large contract amount,long construction period and numerous stakeholders,among which the most distinctive feature is building activities occurring in overseas countries.Because the project is subject to the legal constraints of the country(region)where the project is located,international projects are often faced with exchange rate,politics,price rise and other risks.For projects that executed in Design-Build mode,the best way to avoid these risks in the project implementation process is to use contracts to manage the participants.In this paper,the characteristics of contract,risk identification and factors of contract risk under DB mode are introduced,and the measures of contract risk management are elaborated in detail,and the healthy development of international project contract management is explored,so as to help improve the capability of construction enterprises to cope with contract risks in international projects.
