摘　　要：在行政日趋民主化的现代社会,行政执法和解具有降低行政执法成本、促使解决行政纠纷的重大作用。如今的理论框架已经初步建立,而实践中行政执法和解却面临着难以投入适用和缺乏具体应用的难题。如何在行政领域实现行政执法和解制度的高度本土化,并将其真正地运用到实践之中,是行政法学界历来的讨论热门。参考借鉴英美国家的经验,本文认为引入企业合规制度并将其作为行政执法和解的必要条件,可以改善当下所存在的问题,实现行政执法和解制度的优化升级。而在未来,监管部门应加快建立行政监管激励机制、重视企业合规机制的运作和审查并建立第三方监督评估,且在此基础上进一步改善,形成更加完备的以企业合规为核心的行政执法和解制度体系。In the modern society with the increasing democratization of administration,administrative law enforcement reconciliation,as a new mechanism to deal with administrative disputes in recent years,plays an important role in reducing the cost of administrative law enforcement and pro-moting the settlement of administrative disputes.Now the theoretical framework has been in-itially established,but in practice,administrative law enforcement reconciliation is faced with the problem of limited scope of application and lack of concrete application.How to realize the highly localization of administrative law enforcement and reconciliation system in the administrative field and apply it into practice is always a hot topic in the academic circle of administrative law.Referring to the experience of British and American countries,this paper believes that introducing corporate compliance system and taking it as a necessary condition for administrative law en-forcement reconciliation can improve the existing problems and realize the optimization and up-grading of administrative law enforcement reconciliation system.In the future,regulatory author-ities should accelerate the establishment of administrative supervision incentive mechanism,at-tach importance to the operation and review of enterprise compliance mechanism,establish third-party supervision and evaluation,and gradually improve the institutional system of enter-prise compliance in the process of administrative law enforcement and reconciliation.
