摘　　要：人类社会进入工业时代以来,契约型政府成为现代国家建设的原型,但该原型无法妥善应对第二次工业革命带来的社会变迁,形成福利型政府和全权型政府两种变体。到了信息社会,以上政府类型都无法再适应新的时代需求,暴露出各种缺陷。反思型政府和沟通型政府成为新的时代解答。反思型政府对社会复杂性的重视,对分化的强调和对社会自治的期许,使其在信息社会治理方面具有突出优势,但同时存在合法性亏空,忽视人的自主性,造成精英与大众失衡的缺陷。建立在沟通行动理论基础上的沟通型政府兼容了契约型政府和反思型政府的优点,并克服其缺点,通过继承并强化民主法治国家治理经验的方式,为信息社会发展提供了实现人的自由与解放的新可能。Since human society entered the industrial age,contractual government has become the prototype of modern state,but such prototype could not properly cope with the social changes brought about by the second industri-al revolution,and two variants of welfare-based government and total control government were formed.However,in the information society,neither of the above-mentioned government types can adapt to the new needs of the times,and various defects have been revealed.Reflective government and communicative government have become the new answer of the times.The reflective government's emphasis on social complexity,its emphasis on differentiation and its expectation of social autonomy gives it an outstanding advantage in the governance of the information society,but at the same time it suffers from a deficit of legitimacy,neglects human autonomy and creates an imbalance between the elite and the masses.The communicative government based on the theory of communicative action is compatible with the advantages of contractual government and reflective government and overcomes their shortcomings,offering new possibilities for the development of the information society to realize human freedom and emancipation by inheriting and strengthening the experience of democratic rule of law countries.
